Terms & Conditions

These Terms & Conditions explain the rules that apply when you browse Bloom, create an account, place an order, purchase floral arrangements, or use our services.

1. Acceptance of These Terms

These Terms & Conditions govern your access to and use of the Bloom website, online store, products, services, account features, delivery services, and related communications.

By visiting our website, creating an account, placing an order, or purchasing from Bloom, you agree to be bound by these Terms. If you do not agree, please do not use the website or place an order.

2. About Bloom

Bloom is a floral atelier offering premium floral arrangements, curated designs, gifts, and related delivery services. Our products may include fresh flowers, plants, sympathy arrangements, wedding-inspired designs, everyday arrangements, seasonal collections, and custom floral work.

Product availability, colors, floral varieties, containers, packaging, and design details may vary based on seasonality, inventory, delivery location, and florist discretion.

3. Eligibility and Account Registration

You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to place an order through our website.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it when necessary.

4. Product Information and Availability

We make reasonable efforts to display products, colors, descriptions, sizes, pricing, and availability accurately. However, flowers are natural products and may vary in color, shape, size, bloom stage, and appearance.

Images are provided for reference and styling inspiration. The final arrangement may differ while maintaining the overall style, value, and design intention of the selected product.

5. Substitutions

Because flowers and materials are seasonal and perishable, substitutions may be necessary. If a specific flower, vase, container, ribbon, or design element is unavailable, Bloom may substitute an item of equal or greater value while preserving the overall aesthetic and spirit of the arrangement.

For highly specific custom arrangements, we may contact you when a major substitution is required. However, we cannot guarantee exact flower varieties, shades, or containers unless expressly confirmed in writing.

6. Pricing and Payment

All prices are displayed in the currency shown at checkout and are subject to change without notice. Taxes, delivery fees, service fees, and other charges may be added during checkout.

Payment must be authorized and received before an order is prepared or delivered. Bloom may use third-party payment processors to securely process transactions.

We reserve the right to cancel or refuse an order if pricing errors, payment issues, suspected fraud, inventory issues, or delivery limitations occur.

7. Orders and Order Confirmation

After placing an order, you may receive an order confirmation by email or through the website. An order confirmation does not guarantee acceptance if there is an issue with payment, inventory, delivery feasibility, or order details.

Please review all order information carefully before submitting, including recipient name, delivery address, phone number, delivery date, card message, and special instructions.

8. Delivery Policy

Bloom makes reasonable efforts to deliver orders on the requested delivery date. However, delivery times are not guaranteed unless expressly confirmed in writing.

Delivery may be affected by weather, traffic, building access, incorrect addresses, recipient unavailability, facility policies, security restrictions, holidays, high-volume periods, or circumstances outside our control.

If delivery cannot be completed because of incorrect or incomplete information, lack of access, recipient unavailability, or refusal of delivery, additional fees may apply for re-delivery or redirection.

9. Hospital, Funeral Home, and Facility Deliveries

For hospitals, funeral homes, offices, residential buildings, hotels, event venues, and other facilities, delivery may be completed by leaving the arrangement with reception, security, concierge, front desk staff, nurses’ station, funeral home staff, or another authorized facility representative.

Bloom is not responsible for facility restrictions, room changes, patient discharge, memorial schedule changes, service timing changes, refusal by facility staff, or incorrect information provided at checkout.

For sympathy and funeral orders, please provide complete service details, including the name of the deceased, service time, funeral home name, and delivery instructions whenever possible.

10. Cancellations and Changes

Because floral products are perishable and often prepared specifically for each order, cancellation and change requests must be made as soon as possible.

We cannot guarantee changes or cancellations once an order has been prepared, designed, dispatched, or delivered. Approved cancellations may be refunded to the original payment method.

11. Returns, Refunds, and Quality Concerns

Fresh floral arrangements are perishable and are generally final sale. However, your satisfaction matters to us.

If your order arrives damaged, incorrect, or significantly different from what was reasonably expected, please contact us promptly at contact@madebybloom.org with your order information and clear photos of the arrangement.

Bloom may, at its discretion, offer a replacement, partial refund, store credit, or other resolution depending on the circumstances. We may be unable to offer a remedy if the issue is reported too late, if care instructions were not followed, or if the product has been altered, discarded, or moved from its original delivery condition.

12. Care Instructions

Fresh flowers require proper care. Bloom is not responsible for reduced vase life caused by heat, direct sunlight, lack of water, improper trimming, failure to follow care instructions, environmental conditions, or recipient handling after delivery.

13. Gift Messages and User Content

You are responsible for the content of gift messages, notes, reviews, account information, and any other content you submit through the website.

You agree not to submit unlawful, abusive, threatening, defamatory, discriminatory, obscene, misleading, infringing, or otherwise inappropriate content. Bloom reserves the right to refuse or remove content at its discretion.

14. Promotions, Discounts, and Gift Cards

Promotions, discounts, credits, and gift cards may be subject to additional terms, expiration dates, exclusions, and limitations. Unless otherwise stated, promotional offers cannot be combined, transferred, redeemed for cash, or applied retroactively.

15. Intellectual Property

The Bloom name, website design, branding, logos, images, product names, copy, graphics, layouts, and related content are owned by Bloom or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, display, sell, or exploit any part of the website or Bloom content without prior written permission.

16. Prohibited Uses

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, scrape content, upload malicious code, use the site for fraudulent activity, violate applicable laws, infringe third-party rights, or place orders using false or misleading information.

17. Third-Party Services

The website may rely on third-party services such as payment processors, analytics providers, hosting providers, delivery tools, email platforms, social media platforms, or external links.

Bloom is not responsible for third-party websites, policies, services, errors, outages, or processing practices. Your use of third-party services may be subject to their own terms and privacy policies.

18. Disclaimer of Warranties

The website and products are provided on an “as available” and “as provided” basis to the fullest extent permitted by law.

Bloom does not guarantee that the website will be uninterrupted, error-free, secure, or free from harmful components. We do not guarantee exact product appearance, flower varieties, colors, or availability unless expressly confirmed in writing.

19. Limitation of Liability

To the fullest extent permitted by law, Bloom will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, business interruption, or emotional distress arising from your use of the website or purchase of products.

Bloom’s total liability for any order-related claim will not exceed the amount paid for the specific order giving rise to the claim.

20. Indemnification

You agree to defend, indemnify, and hold harmless Bloom and its owners, employees, contractors, service providers, and affiliates from claims, damages, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, violation of law, or infringement of third-party rights.

21. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles, unless a different jurisdiction is required by applicable law.

If Bloom operates under a different legal jurisdiction, this section should be updated before publication.

22. Changes to These Terms

Bloom may update these Terms from time to time. When changes are made, we will update the “Last updated” date above. Your continued use of the website after updated Terms are posted means you accept the revised Terms.
